1. Acknowledgment of Risks
I, the undersigned participant (or parent/legal guardian if participant is a minor), understand and acknowledge that training and participation at Encoded MMA LLC involves inherently dangerous activities including, but not limited to:
• Mixed Martial Arts (MMA)
• Brazilian Jiu-Jitsu and grappling
• Wrestling and takedowns
• Striking (boxing, kickboxing, Muay Thai)
• Sparring and live drilling
• Conditioning exercises and use of training equipment
• Contact with other participants
I understand that these activities carry significant risks of injury, including but not limited to:
Bruises, cuts, sprains, fractures, concussions, dental damage, joint injuries, paralysis, permanent disability, and death.
I knowingly and voluntarily accept all risks, both known and unknown, even if arising from negligence of others.
2. Assumption of Responsibility
I certify that I am physically capable of participating in training.
I agree to immediately inform coaches of any injury, medical condition, or discomfort.
I understand that:
I may be choked, thrown, struck, or otherwise physically engaged.
Accidental injuries are common in combat sports.
Protective gear does not eliminate risk.
I voluntarily choose to participate despite these risks.
3. Release of Liability
In consideration of being allowed to participate, I hereby release and discharge:
Encoded MMA LLC, its owners, members, managers, employees, instructors, volunteers, contractors, and other participants from any and all claims, demands, damages, causes of action, or liability arising from:
• Personal injury
• Property damage
• Medical expenses
• Loss of income
• Death
INCLUDING CLAIMS ARISING FROM NEGLIGENCE.
This release applies to injuries occurring:
• On the premises
• During classes
• During sparring
• During private lessons
• During open mat
• During competitions, seminars, or events
• In parking areas or surrounding property
4. Covenant Not to Sue
I agree that I will not sue or make any legal claim against Encoded MMA LLC for injuries sustained while participating, except in cases of intentional misconduct.
5. Medical Authorization
I authorize Encoded MMA LLC staff to obtain emergency medical treatment if necessary.
I accept full financial responsibility for any medical treatment rendered.
6. Equipment & Conduct Rules
I agree to:
• Follow all instructor directions
• Tap early and release submissions immediately
• Use required safety equipment when instructed
• Train in a controlled and respectful manner
Encoded MMA LLC may terminate my participation at any time for unsafe behavior.
7. Photography & Media Release
I grant permission to Encoded MMA LLC to use photographs or video of me for promotional, educational, and social media purposes without compensation.
8. Membership Understanding
Membership fees pay for access to instruction and facilities, not guaranteed safety.
Injuries may still occur despite supervision.
9. Minors (If Applicable)
I am the parent/legal guardian of the minor participant and agree to all terms on their behalf.
I accept full responsibility for the minor’s participation and risks.
10. Severability
If any part of this agreement is held invalid, the remaining portions shall remain enforceable.
11. Governing Law
This agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
12. Acknowledgment
I HAVE READ THIS AGREEMENT CAREFULLY.
I FULLY UNDERSTAND ITS TERMS.
I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
I SIGN THIS VOLUNTARILY WITHOUT ANY INDUCEMENT.
